Terms of service

Article 1 – General

These Terms of service apply to all offers, orders and agreements concluded through the Touati Gold online store. By placing an order, you agree to these terms. Before you complete your order, we make the applicable terms available electronically so that you can save them.

Mandatory statutory consumer rights always take precedence where a provision of these terms conflicts with them.

Article 2 – Access and account

You confirm that you are at least 18 years old or have the consent of a legal representative.

When placing an order, you may be asked to provide details such as your name, email address, billing details and shipping details. You are responsible for ensuring that this information is accurate, complete and up to date. You are responsible for the secure use of your account and login credentials.

Article 3 – Products

We do our best to describe our products as clearly and accurately as possible. Images and colours may differ because of screen settings. Natural products may have minor variations in colour, harvest, taste or packaging. The product supplied must always conform to the agreement.

Product information, prices and availability may change before you place an order. Once your order has been confirmed, the agreed price and product information apply, except in the case of an obvious error that you could reasonably have recognised.

Article 4 – Orders

By placing an order, you make an offer to purchase. The agreement is concluded after Touati Gold has confirmed the order electronically.

We may refuse or cancel an order for a stated reason, for example in the event of an obvious pricing error, suspected fraud, unavailability or a legal obligation. Any payment already received will then be refunded without undue delay.

Orders are intended solely for personal use and not for resale.

Article 5 – Prices and payment

All prices displayed to consumers are in euros and include VAT and other unavoidable taxes. Shipping costs and any other additional costs are clearly shown before you place the order.

You pay using one of the payment methods available at checkout. Additional payments will be charged only after you have expressly agreed to them.

Article 6 – Shipping and delivery

We deliver to the address that you provide when placing the order and within the period stated in the offer. Unless another period has been agreed, we will deliver no later than 30 days after the agreement was concluded.

If the order is delayed, we will inform you as soon as possible. If delivery does not take place on time, you can give us a reasonable additional period. If delivery still does not take place, you may terminate the agreement. An additional period is not required if we refuse to deliver or if the agreed delivery date was essential.

Touati Gold remains responsible for loss or damage until you, or a third party designated by you who is not the carrier, have received the product. This does not apply if you choose a carrier that we did not offer. More information is available in our Shipping policy.

Article 7 – Right of withdrawal and returns

Our Return and refund policy applies to the right of withdrawal, return shipments and refunds. That policy does not limit your statutory consumer rights.

Article 8 – Statutory warranty

You are always entitled to a product that conforms to the agreement. If a product is damaged, incorrectly delivered or does not have the characteristics that you could reasonably expect, your statutory rights remain fully applicable.

Depending on the circumstances, you may be entitled to free repair or replacement and, where this is not possible or appropriate, a price reduction or termination of the agreement. Any commercial warranty is additional to these statutory rights and does not limit them.

Article 9 – Pre-orders

Some products may be offered as pre-orders. This means that the product is not immediately available when you place the order. The expected dispatch or delivery period is clearly stated on the product page or at checkout before you place the order.

If there is a delay, we will inform you as soon as possible and, where possible, provide a new reasonable delivery period. An estimated date does not give Touati Gold an unlimited right to postpone delivery. In the event of a material delay, you may exercise your statutory rights, including terminating the agreement where the statutory conditions are met.

If delivery becomes permanently impossible, we will cancel the pre-order and refund the amount received without undue delay. The ordinary statutory rules on delivery, warranty and withdrawal remain applicable.

Article 10 – Intellectual property

All content on the website, including text, images, logos and designs, is owned by Touati Gold or used with permission. You may not copy, distribute or use this content commercially without prior permission, except where permitted by law, for example under the right to quote or for permitted private use.

Article 11 – External links and Shopify

The website may contain links to third-party websites or services. To the extent permitted by law, Touati Gold is not responsible for their content or availability. This does not affect our responsibility for our own decisions, content or service providers engaged by us.

Touati Gold uses Shopify as its technical e-commerce platform. However, the purchase agreement is concluded between you and Touati Gold. Shopify is not the seller of our products. Nothing in this article limits your statutory rights against Touati Gold.

Article 12 – Feedback

If you voluntarily submit a review, suggestion or other feedback, we may use it for our services and promotional activities, with respect for your personal data and other legal rights. You confirm that your submission does not infringe the rights of others or contain unlawful content.

Article 13 – Liability and prohibited use

Touati Gold is liable in accordance with applicable law. Nothing in these terms excludes or limits liability where doing so is not permitted by law, including in cases of intent, deliberate recklessness or mandatory consumer rights.

To the extent permitted by law, we are not responsible for loss or damage caused solely by the incorrect or improper use of a product, provided that we supplied clear instructions for use and safety information.

You may not use the website for unlawful purposes, deception, spam, distributing malware or infringing the rights of others. In the event of misuse, we may restrict access to the website or an account. This does not affect any rights that you already have under an existing order.

Article 14 – Force majeure

If performance is temporarily impossible because of circumstances that cannot reasonably be attributed to Touati Gold, obligations may be suspended for as long as that situation continues. We will inform you as soon as possible. Your statutory rights to terminate the agreement and receive a refund in the event of prolonged or permanent non-performance remain applicable.

Article 15 – Privacy and complaints

Personal data is processed in accordance with the Touati Gold Privacy policy. Shopify and other service providers may process data to operate the online store, payments, shipping and other services.

If you have a complaint, please contact us at touatigold.cs@gmail.com. If possible, include your name, order number and a clear description. We will acknowledge receipt and respond within a reasonable period.

Article 16 – Governing law and amendments

These terms and the agreement are governed by Dutch law. If you live as a consumer in another EU or EEA Member State, you retain the protection of the mandatory provisions of the law of your country of residence. Disputes will be submitted to the court that has jurisdiction under applicable law. We prefer to try to resolve any dispute together first.

We may amend these Terms of service for future agreements. The version available when you placed your order will continue to apply to that order. Amendments will not be applied retroactively to your detriment.
